These Terms and Conditions govern the provision of waste collection and related services by Waste Collection Dulwich to residential and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 "Company" means Waste Collection Dulwich, the provider of waste collection and related services.
1.2 "Customer" or "you" means any individual, business, organisation or other entity that requests or uses the services of the Company.
1.3 "Services" means waste and rubbish collection, removal, loading, transportation, and related activities provided by the Company.
1.4 "Waste" means items, materials, rubbish or refuse presented by the Customer for collection under these Terms and Conditions, subject to any exclusions set out herein.
1.5 "Service Area" means the areas in which the Company operates, including Dulwich and other locations the Company may serve from time to time.
2. Scope of Services
2.1 The Company provides waste collection and disposal services within its Service Area, including but not limited to household waste removal, bulky waste collection, garden waste, and certain commercial waste services, subject to applicable legislation and the Company's operational limits.
2.2 The exact nature of the Services, including the type and volume of waste to be collected, the collection date and time window, and any additional requirements, will be agreed with the Customer during the booking process.
2.3 The Company reserves the right to refuse collection of any waste that it reasonably believes to be hazardous, prohibited, incorrectly described, unsafe to handle, or beyond the agreed volume or type specified at the time of booking.
3. Booking Process
3.1 Customers may request a booking by contacting the Company using the communication methods made available by the Company, such as telephone or online enquiry forms.
3.2 When making a booking, the Customer must provide accurate and complete information, including the collection address, contact details, type and approximate volume or weight of waste, access details, and any other relevant information requested by the Company.
3.3 The Company may provide an estimate or quotation based on the information supplied by the Customer. All estimates are given in good faith but are not binding if the waste, location, or access conditions differ materially from the Customer's description.
3.4 A booking will be deemed accepted and a contract for Services formed only when the Company confirms the booking with the Customer, whether verbally or in writing. The Company reserves the right to decline any booking request at its sole discretion.
3.5 The Customer is responsible for ensuring that an authorised person is present at the premises during the agreed collection window, unless otherwise agreed with the Company.
4. Access and Service Conditions
4.1 The Customer must ensure that the Company has safe and reasonable access to the collection point at the agreed time. This includes providing any necessary access codes, parking permissions, or entry instructions in advance.
4.2 If access is restricted or unsafe, the Company may, at its sole discretion, refuse to carry out the Services, apply additional charges to cover wasted time or alternative arrangements, or reschedule the collection.
4.3 The Customer must ensure that waste is presented in a manner that is reasonably safe and manageable for collection, for example bagged where appropriate, separated where required, and not containing sharp or dangerous materials that are not disclosed.
4.4 The Company may charge additional fees if the actual volume, weight, or nature of the waste exceeds the amount or type originally stated at the time of booking, or if additional labour, time, or equipment is required.
5. Payments and Charges
5.1 Prices for Services are stated to the Customer at the time of booking, based on the information provided. All prices are subject to change if the job requirements change or the information provided is inaccurate or incomplete.
5.2 Unless otherwise agreed in writing, payment is due on or before completion of the Services. The Company may require payment in advance or a deposit, particularly for larger or commercial collections.
5.3 Payment may be made by the methods accepted by the Company from time to time, such as cash, debit or credit card, or bank transfer. The Company reserves the right to refuse certain payment methods at its discretion.
5.4 If the Customer fails to make payment on the due date, the Company may suspend further services and charge interest on any overdue sums at the statutory rate permitted by UK law, accruing on a daily basis until payment is made in full.
5.5 All charges are inclusive or exclusive of VAT as stated to the Customer. Where applicable, VAT will be added at the prevailing rate and itemised on the invoice.
6. Cancellations and Amendments
6.1 The Customer may cancel or amend a booking by providing notice to the Company using the same contact methods used for booking or by any other method agreed by the Company.
6.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, the Company will not normally charge a cancellation fee, unless specific arrangements or non-refundable costs have been agreed in advance.
6.3 If the Customer cancels within 24 hours of the scheduled collection time, or fails to provide access to the premises during the agreed collection window, the Company reserves the right to charge a cancellation fee or a call-out charge to cover travel, staffing, and administrative costs.
6.4 Any request to amend a booking, including changes to the date, time, address, or volume and type of waste, is subject to the Company's availability and agreement. The Company may adjust the price to reflect any changes in the Services.
6.5 The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, road closures, or safety concerns. In such cases, the Company will notify the Customer as soon as reasonably practicable and offer a new collection time.
7. Waste Types and Regulations
7.1 The Company operates in accordance with relevant UK waste legislation and regulations. The Customer agrees to comply with all applicable laws relating to the storage, handling, and presentation of their waste.
7.2 The Customer must clearly inform the Company of the type of waste to be collected and must not misdescribe or conceal hazardous or prohibited materials. Prohibited or restricted items may include, but are not limited to, asbestos, clinical or medical waste, certain chemicals, solvents, oils, gas bottles, batteries, and electrical items requiring specialist disposal.
7.3 The Company reserves the right to refuse to collect or handle any waste it considers to be hazardous, illegal, unsafe, or unsuitable for the Services offered. If such waste is identified during collection, the Company may terminate the job, remove only the acceptable portion of waste, or require additional charges for specialist handling where legally permitted.
7.4 Title and responsibility for the waste transfer from the Customer to the Company once the waste has been loaded onto the Company's vehicle, subject to applicable law and the proper classification of the waste by the Customer.
7.5 The Company will use licensed and appropriate disposal or recycling facilities, and will take reasonable steps to maximise recycling and lawful disposal in accordance with applicable regulations.
8. Customer Warranties and Responsibilities
8.1 The Customer warrants that:
(a) they are the owner of the waste or are authorised by the owner to arrange for its removal;
(b) the waste presented for collection has been accurately described to the Company;
(c) the waste does not contain any hidden hazardous or illegal materials; and
(d) access to the premises and waste will be safe for the Company's staff and vehicles.
8.2 The Customer is responsible for securing any necessary permissions, permits, or consents required for the collection, including but not limited to parking dispensations or access permissions for shared or managed premises.
8.3 The Customer must ensure that any fragile, valuable, or non-waste items are clearly removed or marked so they are not mistakenly collected. The Company accepts no liability for the removal of items that the Customer has left in or among waste materials where it was reasonable to assume such items were intended for disposal.
9. Liability and Limitations
9.1 Nothing in these Terms and Conditions shall limit or exclude the Company's liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded or limited under UK law.
9.2 Subject to clause 9.1, the Company shall not be liable for any indirect, consequential, or special loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the provision of the Services.
9.3 Subject to clause 9.1, the Company's total aggregate liability to the Customer in respect of any claim or series of connected claims arising under or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
9.4 The Customer must notify the Company in writing of any claim or complaint relating to the Services within 7 days of the date of collection. The Company will investigate any complaint and may, at its discretion, offer a remedy such as a partial refund, re-service, or other appropriate resolution.
9.5 The Company will take reasonable care when operating at the Customer's premises. However, the Company shall not be liable for any damage to driveways, paths, access routes, or surfaces caused by the weight or movement of vehicles, where the Customer has requested or agreed that vehicles enter or park within the boundary of the premises.
10. Insurance
10.1 The Company maintains appropriate public liability and employer's liability insurance in connection with its waste collection operations.
10.2 Evidence of insurance cover can be provided to the Customer upon reasonable request.
11. Data Protection and Privacy
11.1 The Company will collect and process personal data about Customers in order to provide the Services, manage bookings, take payment, and handle enquiries and complaints.
11.2 The Company will handle personal data in accordance with applicable UK data protection laws and will take reasonable measures to keep such data secure.
11.3 The Customer is responsible for ensuring that the contact details and information supplied to the Company are accurate and kept up to date.
12. Changes to These Terms
12.1 The Company may amend these Terms and Conditions from time to time to reflect changes in law, operational requirements, or the nature of the Services provided.
12.2 The current version of the Terms and Conditions will apply to each booking. Customers are encouraged to review the Terms and Conditions before confirming a booking.
13. Governing Law and Jurisdiction
13.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
13.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation.
14. General Provisions
14.1 If any provision of these Terms and Conditions is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
14.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
14.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the Company's prior written consent. The Company may assign or transfer its rights and obligations to another organisation as part of its business operations.
14.4 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior understandings or agreements.
